PMC Process Consultants (Pty) Ltd ("PMC") is committed to full compliance with the Protection of Personal Information Act 4 of 2013 ("POPIA") of the Republic of South Africa. This statement sets out how PMC fulfils its obligations as a responsible party under POPIA in connection with the PDS — Process Data System platform.

POPIA establishes eight conditions for lawful processing of personal information. PMC's commitments against each condition are set out below.
PMC has designated an Information Officer responsible for ensuring compliance with POPIA. This officer is registered with the Information Regulator as required.
PMC processes personal information only for lawful, specific, explicitly defined, and necessary purposes related to delivery of the PDS service. We do not process information in a manner that is excessive or incompatible with the original purpose.
Personal information is collected for clearly defined purposes — service delivery, account management, support, and (where consented) marketing communication. Information is retained only as long as necessary for those purposes.
PMC does not process personal information beyond the original purpose unless the data subject has given consent, the further processing is compatible with the original purpose, or it is required by law.
PMC takes reasonable steps to ensure that personal information is accurate, complete, and kept up to date. Users may request corrections at any time.
PMC maintains this POPIA Statement and the accompanying Privacy Policy to inform data subjects of our processing activities. We notify data subjects when their information is collected or when the purpose of processing changes materially.
PMC implements appropriate technical and organisational measures to protect personal information. PDS is remotely hosted with access controls, regular backups, and encrypted data transmission. PMC is ISO 9001:2015 Certified for Mineral Resource Evaluation Services, which includes quality management practices relevant to data integrity. In the event of a data breach that is likely to affect the rights and interests of data subjects, PMC will notify the Information Regulator and affected data subjects without unreasonable delay.
Data subjects have the right to know whether PMC holds their personal information, to access it, to request corrections, and to request deletion (subject to legal retention requirements). Requests may be submitted to the Information Officer at info@pmc-pds.co.za.
PMC does not intentionally collect special categories of personal information (such as health data, biometric data, or information about criminal records) in connection with the PDS platform. Where such data is contained in operational log sheets submitted by clients, it is processed solely on the client's instruction and is subject to the data processing provisions in the relevant Scope of Works.
PMC may use cloud hosting or CRM services whose infrastructure is located outside South Africa. In such cases, PMC ensures that the recipient country provides an adequate level of protection, or that appropriate safeguards (such as contractual protections) are in place, as required by section 72 of POPIA.
Where PMC engages third-party operators to process personal information on its behalf (e.g. cloud hosting providers, CRM platforms), PMC enters into written agreements that require operators to comply with the conditions of POPIA and to maintain appropriate security safeguards.
PMC may send electronic direct marketing communications only to persons who have given their consent, or to existing clients in respect of similar services (as permitted under POPIA). Every marketing communication includes a clear and functional opt-out mechanism. Opt-out requests will be processed promptly and at no cost to the data subject.
